    What is the slander law in Ecuador?

    How does anyone report that a person, a business or an institution has actually done you harm?

    Let’s say you have the proof. Let’s say you have paid thousands of dollars for their mistake.

    According to my attorney, I am protected by the Ley Orgánica de Defensa del Consumidor. But this requires that I sue them, and it assumes I want my money back.

    But maybe I just want to tell people what happened so the same thing does not happen to them. My attorney says I cannot publicize their error because “under our constitution all people are protected by a good name and honor.”

    Is this the so-called slander law we gringos have heard about? I have some questions.

    First of all, what does the law actually say?

    Second, what is the remedy for harm? Is filing a lawsuit the only way to get justice?

There will be no criminal liability if the author of slander voluntarily retracts it before an enforceable judgment is issued, provided that the publication of the retraction is made at the expense of the of the responsible party, is carried out in the same medium and with the same characteristics in which it was disseminated imputation. Recantation is not a form of acceptance of guilt. It appears as though there is a distinction between saying something bad about someone (defamation) - as opposed to slander - which is a false accusation of a crime. So whereas you have a legitimate cause for complaint and able to take civil action, you may NOT defame them by saying negative things about them, regardless of their truth.     There are two laws relating to your question. One is slander. The one relating to your question is defamation. In Ecuador you cn be sued for defamation if you post anything that defames a person whether or not it is the truth. 0 0

Your posting is a little "scattered" (since persons, businesses, and institutions are all very different animals and covered by different laws). "Slander" is different than financial (or physical) "harm" or "damages" and remedies are different in every country and, as far as I know, all require legal/official review and decisions.
